This website is operated by Oryxearth. Throughout the Site, the terms “we,” “us,” and “our” refer to Oryxearth.

By visiting oryxearth.com, purchasing a product, creating an account, or otherwise using our website and services, you agree to these Terms of Service and all policies referenced on the Site.

Please do not use the Site if you do not agree to these Terms.

1. Online Store Terms

You must be at least the age of majority in your state of residence to make a purchase. Products intended for minors must be purchased by a parent, legal guardian, or responsible adult.

You may not use the Site or our products for any illegal, unauthorized, unsafe, or prohibited purpose.

You may not introduce viruses, malicious code, automated scraping tools, or other technology that interferes with the security or operation of the Site.

We may suspend or terminate access to the Site if these Terms are violated.

2. Product Use and Local Requirements

Customers are responsible for reviewing product specifications, safety warnings, age recommendations, weight limits, assembly instructions, maintenance requirements, and intended uses before purchase.

Minibikes, dirt bikes, electric vehicles, boats, and other recreational products may be subject to federal, state, county, city, HOA, community, licensing, registration, age, safety, and riding restrictions.

You are responsible for confirming that a product can be legally purchased, delivered, registered, and used in your location.

Unless expressly stated otherwise, our recreational vehicles are not represented as street legal.

Products must be assembled, operated, maintained, and supervised in accordance with the applicable product manual and safety instructions. Appropriate protective equipment should always be used.

3. Product Information

We make reasonable efforts to provide accurate product descriptions, specifications, images, colors, pricing, and availability.、

Actual colors and appearance may vary because of screen settings, lighting, manufacturing updates, or normal production differences.

Measurements, speeds, ranges, operating times, weight capacities, and performance figures are estimates unless expressly guaranteed. Actual performance may vary based on rider weight, terrain, weather, maintenance, battery condition, operating habits, and other factors.

We may update product designs, specifications, packaging, accessories, or components when the replacement is functionally equivalent and does not materially reduce the product’s intended performance.

4. Prices and Payments

Prices are shown in U.S. dollars unless otherwise stated and may change without notice.

Applicable taxes, shipping charges, special delivery fees, or other disclosed charges will be calculated at checkout or communicated before fulfillment when necessary.

You agree to provide current, complete, and accurate billing, shipping, payment, and contact information.

By submitting an order, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to charge the applicable amount.

Promotional codes, discounts, and offers:

  • Must be used according to their stated terms;
  • Cannot be combined unless expressly permitted;
  • Have no cash value;
  • May be limited by product, customer, location, or time period; and
  • May be modified or discontinued where permitted by law.

5. Orders and Order Verification

Submitting an order does not guarantee acceptance.

We may verify payment information, identity, billing address, shipping address, telephone number, or other order details before shipment.

We reserve the right to refuse, limit, hold, or cancel an order for legitimate reasons, including:

  • Product unavailability;
  • Pricing or listing errors;
  • Payment authorization failure;
  • Suspected fraud or unauthorized activity;
  • Billing and shipping information mismatch;
  • Shipping or legal restrictions;
  • Unusual order quantity;
  • Suspected resale activity; or
  • Inability to complete necessary verification.

If we cancel an unshipped order after payment has been collected, the applicable amount will be refunded to the original payment method..

6. Order Cancellations

You may request cancellation before shipment by contacting saleservice@oryxearth.com.

Cancellation is not guaranteed after an order has entered warehouse processing, been packed, had a shipping label created, been scheduled for carrier pickup, or been transferred to a carrier.

Once an order ships, it will be handled according to our Return & Refund Policy.

7. Shipping and Delivery

Shipping eligibility, processing periods, estimated delivery times, carrier services, free-shipping terms, address restrictions, freight delivery requirements, and shipping-damage procedures are governed by our Shipping Policy.

Delivery dates are estimates and are not guaranteed unless expressly stated otherwise.

Customers are responsible for providing an accurate and complete shipping address and valid contact information.

The customer may be responsible for additional costs resulting from an incorrect address, missed appointment, unauthorized refusal, failure to collect a shipment, restricted delivery location, storage, redelivery, or another customer-caused delivery issue.

If shipment is delayed beyond a promised shipping period, we will provide the options required by applicable law.

8. Inspection After Delivery

You should inspect the shipment promptly after delivery.

Visible shipping damage must be reported within three business days in accordance with our Shipping Policy and Return & Refund Policy.

Keep all cartons, pallets, foam, straps, labels, and packaging materials until any shipping claim has been reviewed.

Failure to report visible damage promptly may affect our ability to pursue a carrier claim and may limit the remedies available for shipping-related damage.

9. Returns and Refunds

Returns, refund eligibility, return shipping responsibility, deductions, non-returnable products, refused shipments, and refund processing are governed by our Return & Refund Policy.

All returns require prior written authorization. Products returned without authorization may be refused.

The customer is generally responsible for return shipping and applicable original shipping costs when the return is caused by a personal reason.

Oryxearth will pay reasonable authorized return shipping when the return is required because of a confirmed manufacturing defect, shipping damage, incorrect product, or another verified Oryxearth error.

Nothing in these Terms limits a consumer right that cannot legally be waived.

10. Limited Warranty

Eligible products purchased directly from the official Oryxearth website are covered according to our 90-Day Limited Warranty.

The limited warranty is separate from the 30-Day Return & Refund Policy.

Warranty remedies may include troubleshooting, replacement parts, repair, product replacement, partial refund, or another reasonable solution, depending on the issue and applicable law.

Warranty coverage does not include normal wear, accidents, misuse, improper assembly, unauthorized modifications, commercial use, or damage caused by incompatible parts or improper repairs.

11. Third-Party Services and Links

The Site may use or link to third-party services, including payment providers, financing companies, carriers, analytics services, advertising platforms, social-media services, and other websites.

Third-party services are governed by their own terms and privacy policies.

We are not responsible for the content, availability, security, accuracy, products, or practices of an unaffiliated third party.

Any transaction entered directly with a third party is between you and that third party.

12. Reviews, Comments, and User Content

When you voluntarily submit a review, photograph, video, comment, suggestion, or other content to us, you confirm that:

  • You own the content or have permission to submit it;
  • The content is accurate and not misleading;
  • The content does not violate another person’s intellectual-property, privacy, publicity, or other rights;
  • The content is not unlawful, threatening, abusive, obscene, defamatory, or fraudulent; and
  • The content does not contain malicious software.
You grant Oryxearth a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, translate, display, and distribute submitted content for customer service, marketing, product improvement, and other lawful business purposes.

We may remove or decline to publish content that violates these Terms.

We are not required to compensate you for unsolicited suggestions or submitted content unless separately agreed in writing.

13. Intellectual Property

The Site and its content, including trademarks, brand names, logos, product images, videos, text, graphics, designs, and software, are owned by or licensed to Oryxearth and are protected by applicable intellectual-property laws.

You may use the Site only for personal, non-commercial shopping and informational purposes.

You may not copy, reproduce, modify, distribute, sell, scrape, publish, or commercially exploit Site content without prior written permission.

14. Prohibited Activities

You may not use the Site to:
  • Violate any law or another person’s rights;
  • Submit false, fraudulent, or misleading information;
  • Commit payment fraud or unauthorized transactions;
  • Harass, threaten, discriminate against, or impersonate another person;
  • Upload malicious code;
  • Collect other users’ personal information;
  • Send spam or conduct phishing activity;
  • Scrape, crawl, or access the Site through unauthorized automated means;
  • Interfere with Site security or operation; or
  • Circumvent purchase, geographic, account, or security restrictions.
We may restrict access, cancel orders, or take other appropriate action when prohibited activity is suspected.

15. Privacy

Our collection, use, retention, and disclosure of personal information are governed by our Privacy Policy.

By using the Site, you acknowledge that information may be processed by Shopify and other service providers necessary to operate the store, process payments, fulfill orders, prevent fraud, and provide customer service.

16. Errors and Corrections

The Site may occasionally contain typographical errors, inaccurate information, or omissions relating to product descriptions, specifications, pricing, promotions, availability, shipping charges, or delivery estimates.

We may correct material errors, update information, or cancel affected orders where permitted by law.

If an order is canceled because of an error after payment was collected, the applicable amount will be refunded to the original payment method.

17. Website Availability

We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free.

We may modify, suspend, or discontinue any part of the Site or its functionality for maintenance, security, operational, or business reasons.

This section does not affect obligations relating to orders already accepted or rights provided by applicable law.

Except for warranties expressly provided in our 90-Day Limited Warranty or otherwise required by law, the Site and its online services are provided on an “as available” basis.

To the maximum extent permitted by law, we disclaim implied warranties relating solely to operation of the Site.

Nothing in these Terms excludes or limits an express product warranty or consumer protection that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Oryxearth and its affiliates, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Site or products purchased through it.

This may include loss of profits, income, data, business opportunity, or product use.

Our total liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim, except where a different remedy is required by applicable law.

These limitations do not apply to liability that cannot lawfully be limited, including where applicable liability for fraud, willful misconduct, or personal injury caused by conduct for which liability cannot be excluded.

Some states do not allow certain limitations, so part of this section may not apply to you.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold Oryxearth harmless from third-party claims, losses, or reasonable expenses arising from:

  • Your unlawful use of the Site;
  • Your material violation of these Terms;
  • Your violation of another person’s rights; or
  • Your misuse, unauthorized modification, or unlawful operation of a product.
This provision does not require you to indemnify Oryxearth for claims caused by Oryxearth’s own unlawful conduct.

21. Severability

If any provision of these Terms is found unlawful or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

22. No Waiver

Failure to enforce a provision of these Terms does not waive the right to enforce it later.

23. Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

Nothing in this section prevents a consumer from relying on mandatory protections available under the laws of their state of residence.

24. Changes to These Terms

We may update these Terms to reflect changes in our products, services, business practices, technology, or legal requirements.

The updated Terms will be posted on this page with a revised “Last Updated” date.

Changes will not retroactively reduce rights relating to an order already placed unless permitted by law.

25. Entire Agreement

These Terms, together with the policies referenced on the Site, constitute the agreement between you and Oryxearth regarding use of the Site and purchases made through it.
